Interrogating
Description
Asking questions in order to obtain evidence regarding a crime.
Context
Most nations have limitations on the length of time which a person can be held for interrogation. Many have provisions for protecting prisoners from undue coercion during interrogation. There are often restrictions on the admissibility in court of confessions or other evidence obtained during interrogation.
Claim
In any judicial system based on law, in which the prisoner is innocent until proven guilty, interrogation of defendant and of witnesses is an extremely important and just component.
Counter-claim
True deterrence occurs only when wrongdoers and potential wrongdoers are terrified at the consequences of their acts, a state which interrogation does not elicit.
