Stealthing is the act of deliberately removing a condom before or during sex without the other person’s consent.
Stealthing is defined as having occurred if “the person agrees to engage in the activity because of a misrepresentation (whether express or implied) as to the use of a condom during the activity”.
In most States of Australia, the law specify stealthing as a factor negating consent, meaning if you’re found guilty of stealthing you could be convicted of rape: having sexual intercourse with another person who does not consent to sex or has withdrawn their consent.
