Denial of right to a legal defence

  • Violation of right to a defence against criminal charges

Incidence

A former merchant bank on charge of fraud in the UK found himself unable to afford to hire legal representatives at the same time as the antiquated and complex fraud trial procedures made it almost impossible to defend himself. He calculated that had he used lawyers, at rates of £200 an hour, he could already have spent close to £1 million for the 40 days in court since the trial started.
